Not long ago Colonial Country Club signed a gas lease. Texas Christian University has signed a letter with Four Sevens of intent for its’ gas rights. It has come to the attention of the Neighborhood Association that several neighbors have received individual gas lease offers.


The Tanglewood Neighborhood Association has formed a committee to investigate this unique situation. Recently several committee members participated in a meeting held with TCU to discuss gas development at the University and how to address the needs of the local neighborhoods. The committee has also been in communication with other neighborhood associations to learn how they have dealt with similar solicitations.


The committee would like to negotiate lease terms for the neighborhood, other neighborhood associations have done this for the benefit of the neighbors. We have approximately 500 households within the bounds of the association. As a group we hold a stronger position than that of individuals. We also can tap into vast wealth of knowledge within the neighborhood and will have benefits sharing legal counsel and information with every one in the neighborhood.


The committee is soliciting feedback from the neighborhood and has set up a special email address: “gaslease@tanglewood-neighbors.org”. We would like to hear from you. Please send us any questions or concerns that you might have. If you have received a solicitation please let us know about it.

We have had a lot of questions on legal fees for representation.
Below is the Neighborhood Association policy on Legal Fees:

The TNA will pay any legal fees through the membership dues and donations.
Any person agreeing to participate with the association will NOT be required to pay any legal fees. Donations will be appreciated but not required.

May 03, 2007 Update:

We have received input from the various Gas Companies that the majority of Tanglewood Property owners retain the mineral rights.
We want to place a significant emphasis on protecting our properties and environment in our negotiations with the Gas Companies.
Turner Oil, Chesapeake and Four Sevens and will participate in our May 14th General Meeting to answer any questions. Please try to attend.
The TNA will close the Engagement Letter process at the end of May and then move forward with the negotiations process.
We have received over 70 neighbors participating in the TNA Group Efforts to negotiate with Gas Companies and expect a significant amount more in the next several weeks.

May 16, 2007 Update:

June 11, 2007 Update:

Currently have 115 neighbors signed up to participate in the TNA negation process.
We are now ready to start the negotiation process with the Gas companies.
All discussions will be kept confidential until we complete final terms and conditions.
When the terms and conditions are set, the committee will share the lease agreement with the neighbors to review and execute if they decide to participate.
  1. August 15, 2007 Update:


The Tanglewood Neighborhood Association Gas Lease Committee will be recommending our neighbors sign a lease agreement granting Vargas Energy, Ltd. (in partnership with XTO Energy Inc.) the right to develop gas from the Barnett Shale formation.  Over the last several months, the committee has focused its gas lease evaluation efforts on attempts to protect our properties from unwanted environmental hazards and noise pollution, and to optimize the financial terms for everyone.  We believe Vargas and XTO, with their local presence and stated commitment to the integrity of our neighborhood, present a logical choice.  Of course, the ultimate decision of whether or not to enter into a lease with Vargas/XTO, or any other operator, rests with each individual property owner in our neighborhood. 


The Tanglewood and Overton Park neighborhoods originally were part of the Edwards Ranch, which was established in 1848.  Vargas Energy, Ltd., is a wholly owned subsidiary of the Edwards family interests.  The Tanglewood and Overton Park neighborhoods are part of an anticipated project area that encompasses approximately 5,000 acres.  The surface location drill sites are on lands owned or controlled by Edwards/Vargas and located west of Hulen Street.  Vargas and XTO have expressed a commitment to place great importance on maximizing the mineral estate while preserving and protecting surface values.  XTO Energy Inc., a local Fortune 500 company and the second largest producer of Barnett Shale gas, will be the operator of the project.

 

We have finalized the lease agreement, which provides for the following terms:


$10,000 per acre bonus consideration.

One-fourth royalty.

Three-year primary term.


A form of lease which we believe to be acceptable has also been agreed to by Vargas/XTO.


Further details will be provided during our August 27th General Meeting.

  1. August 31, 2007 Update:


The Gas Lease from XTO Energy Inc. and Vargas Energy, Ltd. will be mailed soon.  The mailing will provide instructions on how to participate in the Gas Lease recommended by the Tanglewood Neighborhood Association.

 

You will have the option to participate in the lease by completion of the required paperwork and return to Vargas Ltd. or by participating in the Gas Lease Signing Party.
